These Terms & Conditions ("Terms") govern your use of the website and services provided by Millcreek AI Automations ("Millcreek," "we," "us," or "our"). By accessing our site or using our services, you agree to these Terms. If you do not agree, please do not use our site or services.
Our services
Millcreek provides AI receptionist services for HVAC and plumbing businesses. Our service answers inbound and after-hours calls, qualifies callers, captures job details, and notifies the business. The specifics of each engagement — including setup, call handling rules, and notifications — are agreed with each client.
Free pilot and billing
We offer a 30-day free pilot for new clients. To start a pilot, a valid payment method is placed on file but is not charged during the free period. If you choose to continue after the pilot, the service is billed at the agreed monthly rate (currently $497/month) until cancelled. You may cancel at any time; cancellation stops future billing but does not refund fees already incurred. Pricing and plan details may be updated on a going-forward basis with notice.
Your responsibilities
If you use our services for your business, you agree to:
- Provide accurate business and contact information and keep it current.
- Use the service only for lawful purposes and in compliance with applicable laws and regulations, including telephone and messaging rules.
- Obtain any consents required from your own customers for call recording, messaging, or follow-up, where applicable.
- Review captured job information and handle emergencies and dispatch according to your own procedures.
Acceptable use
You may not misuse our services, including by attempting to disrupt or reverse-engineer the service, using it to send unlawful or unsolicited messages, infringing others' rights, or using it in a way that could harm Millcreek, its clients, or third parties.
AI limitations and no guarantee of results
Our service uses automated AI systems. While we work to make it accurate and reliable, AI can make mistakes, misunderstand callers, or miss information. The service is a tool to assist your business and is not a substitute for human judgment or emergency services. We do not guarantee that every call will be answered or captured, or that the service will produce any specific business result, number of booked jobs, or revenue.
No professional advice
Information provided by Millcreek or through the service is for general operational purposes and is not legal, financial, or professional advice.
Intellectual property
The website, service, software, and related materials are owned by Millcreek or its licensors and are protected by applicable laws. These Terms do not grant you any ownership rights in our intellectual property.
Disclaimer of warranties
The site and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Millcreek and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, data, or business, arising out of or related to your use of the site or services. Our total liability for any claim relating to the services will not exceed the amount you paid us for the services in the three months before the claim arose.
Indemnification
You agree to indemnify and hold harmless Millcreek and its owners from claims, damages, and expenses arising out of your use of the services, your business operations, or your violation of these Terms or applicable law.
Termination
You may stop using the services at any time. We may suspend or terminate access if you violate these Terms, misuse the service, or if we discontinue the service. Provisions that by their nature should survive termination will continue to apply.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Utah.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site or services after a change means you accept the updated Terms.
